Welcome to Japanstones.shop. The terms “we”, “us”, and “our” refer to Japanstones.shop. We operate this website and the related information, content, features, tools, products, and services provided through it (the “Services”). Japanstones.shop is powered by Shopify, which enables us to provide the Services.

These Terms of Service (“Terms”) describe your rights and responsibilities when using the Services. By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Access and Account

You confirm that you are legally able to enter into these Terms in your jurisdiction, or that you have the required consent of a parent or legal guardian. You must provide accurate, current, and complete information when requested, including contact, billing, payment, and shipping information. You are responsible for keeping account credentials secure and for activity carried out through your account.

2. Our Products

We make reasonable efforts to describe and display our products accurately.

Unless otherwise stated in the product description, the actual item shown in the product photographs is the item you will receive. For products consisting of multiple parts or components, the photographs may show the complete product or its individual components.

Because photographs are taken under particular lighting and camera conditions and are viewed on different devices and displays, the color, tone, texture, surface details, and overall appearance of the actual product may differ slightly from how it appears in the photographs. Such differences in photographic or screen representation do not mean that a different item has been supplied.

Natural stone may also contain natural variations, mineral patterns, veins, grains, pores, inclusions, weathering, surface irregularities, tool marks, and other characteristics inherent to the material or hand-crafted production. These characteristics are part of the nature and individuality of stone products unless otherwise stated in the product description.

Product details, availability, and quantities may change before an order is accepted. Large, heavy, or special-order products may require a separate quotation, shipping arrangement, or written terms before acceptance.

3. Orders

When you submit an order, you make an offer to purchase. We may accept or decline an order, or request additional information, at our discretion and subject to applicable law. An order is accepted when we send an order-acceptance confirmation or otherwise confirm that we will fulfill it. An order-receipt message only confirms that we received your request.

Please review your order before submitting it. Cancellation requests are handled under our Refund Policy and may be limited after processing or shipment.

Products may be purchased for personal use, business use, resale, or export, subject to our order-acceptance policies and applicable laws. Buyers are responsible for complying with the import, export, customs, product, and regulatory requirements of the destination country and for paying applicable customs duties, import taxes, and related fees.

4. Prices and Billing

Prices and promotions may change. The applicable product price is the price shown at checkout and in the accepted-order confirmation, unless an obvious pricing or technical error is identified before acceptance. Shipping charges, taxes, handling charges, and import duties are excluded unless expressly stated otherwise.

You must provide accurate and complete billing and payment information. You confirm that you are authorized to use the selected payment method and agree to pay all applicable charges. If an obvious error affects an order before acceptance, we may notify you and give you the option to confirm the corrected price or cancel for a refund.

5. Shipping and Delivery

Available destinations, shipping methods, shipping charges, delivery estimates, and applicable restrictions are described in our Shipping Policy and, where applicable, in a separate quotation or order arrangement.

Delivery estimates are not guaranteed. Delays may result from carriers, customs, weather, inspections, or other events outside our reasonable control. You must provide an accurate delivery address and cooperate with customs or carrier requests. Import duties, import taxes, brokerage charges, permits, and other destination-country charges are the buyer’s responsibility unless we expressly state otherwise.

Damage, shortage, or delivery problems must be reported in accordance with the Refund Policy and any carrier requirements. Nothing in these Terms limits rights that cannot be excluded under applicable law.

6. Intellectual Property

Trademarks, text, images, graphics, videos, layouts, and other content in the Services are owned by Japanstones.shop or our licensors and are protected by applicable intellectual-property laws.

You may use the website and its content for personal, non-commercial browsing and evaluation. Without our prior written permission, you may not reproduce, copy, download, screenshot, scrape, modify, translate, republish, distribute, publicly display, commercially use, or create derivative works from any image, photograph, text, product description, graphic, video, layout, or other content in the Services, in whole or in part. This prohibition applies to use on websites, marketplaces, social media, catalogs, advertisements, and datasets. Providing a link to or crediting Japanstones.shop does not by itself grant permission.

The purchase, import, export, or lawful resale of a product from Japanstones.shop does not grant any license or right to use, reproduce, copy, download, republish, distribute, or commercially use our photographs, product descriptions, videos, graphics, or other website content. This content-use restriction does not prohibit the lawful purchase, import, export, or resale of products purchased from Japanstones.shop.

9. Relationship with Shopify

Shopify provides the e-commerce platform that supports the Services. Your purchase contract is with Japanstones.shop, not Shopify. Nothing in these Terms excludes or limits any responsibility or right that cannot lawfully be excluded or limited.

10. Privacy

Personal information is collected and processed as described in our Privacy Policy and the applicable Shopify privacy information.

11. Feedback

If you submit reviews, suggestions, photographs, or other content (“Feedback”), you give us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that Feedback for operating, improving, and promoting the Services. You confirm that you have the rights needed to submit it and that it does not violate another person’s rights or applicable law.

12. Errors and Inaccuracies

The Services may occasionally contain errors or omissions relating to product descriptions, pricing, availability, or shipping. We may correct such errors. If a correction materially affects an order that we have already accepted, we will notify you and provide any cancellation, refund, or other remedy required by applicable law.

13. Prohibited Uses

You may not use the Services for unlawful, abusive, fraudulent, deceptive, or harmful activities, including violating laws or regulations, infringing intellectual-property rights, harassing others, uploading malware, impersonating another person, or spamming.

Provisions concerning intellectual property, Feedback, payment obligations, liability, dispute resolution, and privacy survive termination.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee uninterrupted or error-free operation. Products are supplied in accordance with their product descriptions and applicable law. Nothing in this section excludes or limits statutory consumer rights, mandatory product guarantees, or remedies that cannot be excluded.

16. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Services or a product. This limitation does not apply to liability that cannot legally be excluded or limited, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

This section does not require you to indemnify us for our own unlawful conduct or for rights that cannot be waived.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will be interpreted or replaced to the minimum extent necessary to make it enforceable while preserving its purpose.

19. Waiver and Entire Agreement

Our failure to enforce a provision is not a waiver of our right to enforce it later. These Terms, together with the policies and order-specific terms expressly incorporated into them, form the agreement between you and Japanstones.shop concerning the Services.

20. Assignment

You may not assign your rights or obligations under these Terms without our written consent, except where prohibited by law. We may assign these Terms as part of a transfer or reorganization of the business, provided that your mandatory rights are not reduced.

21. Governing Law and Disputes

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rights, disputes will be submitted to the courts having jurisdiction in Aichi, Japan. If mandatory law gives you the right to bring a claim elsewhere, that right is preserved.

23. Changes to These Terms

We may update these Terms when our Services, policies, or legal obligations change. The updated version will be posted on this page with its effective date. Changes will not retroactively alter an order that we have already accepted unless required by law or agreed with you. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.
